A couple of things don't jive.
1) Ok, I think we've all assumed that the person who caught Kate was the marshall, assuming that's true (and he's not some sort of bounty hunter instead), how did Sawyer get his gun? I understand taking stuff off dead bodies, but live ones?
2) Sawyer can obviously use a gun, has relatively good aim, he took down a moving target (the bear), but he doesn't know where to shoot to kill a human? That doesn't quite jive.
3) Why was he so anxious to put the marshall out of his misery? If the breathig noise was bothering him, why didn't he just move to a different part of the beach? Tjhe action did bother him, so why do it?
4) How did he get the gun from Kate, did she give it to him? Did he take it from her? Did she leave it in the tent expecting Sawyer to do it?
